Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of ShopsAroundU (“we”, “us”, or “our”), including our mobile applications, web panels, and related services (collectively, the “Services”). By creating an account, signing in, or using the Services, you agree to these Terms.
1. Nature of our service
ShopsAroundU provides a technology platform that connects customers directly with shop owners so customers can discover and obtain products and services from shops in nearby places. We are a facilitator / marketplace technology provider. We do not ourselves sell the products listed by shops, and we do not operate as the seller, manufacturer, or primary service provider of those goods.
Any sale of products or provision of shop services through the Apps is a transaction between the customer and the respective shop owner.
2. Eligibility and accounts
- You must provide accurate registration information (phone number, email, or other details we request).
- You are responsible for safeguarding your login credentials and for activity under your account.
- Shop owner / admin accounts may only be used by authorised personnel of that shop.
- We may suspend or terminate accounts that violate these Terms or applicable law.
3. Customer orders
- Orders placed through the Customer App are offers to purchase from the listed shop owner.
- Product details, prices, availability, delivery charges, and estimated times are set and shown by the shop and may change.
- Shop owners may accept, reject, or modify orders based on stock and their own operations.
- Payment, refunds, cancellations, substitutions, and product quality issues must be resolved with the shop owner, subject to options shown in the App and applicable law.
4. Shop owner responsibilities (products, pricing & sales)
Shop owners who list and sell products or services through ShopsAroundU have whole and sole responsibility for:
- Product authenticity, quality, description, packing, and fitness for purpose
- Pricing, offers, discounts, taxes (as applicable), and billing accuracy
- Stock availability and timely order fulfilment
- Any product-related complaints, defects, shortages, replacements, or refunds
- Compliance with applicable food, trade, licensing, labelling, and tax laws
ShopsAroundU is not responsible for incorrect prices, product issues, quality disputes, or other claims arising from products sold by shop owners on the platform.
5. Delivery partners — shop owner responsibility
Shop owners may register and manage delivery boys / delivery partners through the Services to deliver orders for their shop. Delivery partners work for or on behalf of the shop owner, not as employees or agents of ShopsAroundU.
- The shop owner takes complete responsibility for recruiting, verifying, training, assigning, and supervising delivery partners.
- The shop owner is solely responsible for delivery performance, delays, mishandling, loss or damage of goods in transit, conduct of delivery partners, and related customer complaints.
- Any employment, contract, wages, insurance, or statutory obligations related to delivery partners are between the shop owner and the delivery partner.
ShopsAroundU only provides tools to help shop owners connect with customers and coordinate delivery workflows; we do not control day-to-day delivery operations.
6. Acceptable use
You agree not to:
- Use the Services for unlawful, harmful, or fraudulent purposes
- Interfere with platform security, availability, or other users’ access
- Scrape, reverse engineer, or misuse APIs or content except as allowed by law
- Impersonate another person or misrepresent your affiliation with a shop or organisation
7. Intellectual property
ShopsAroundU branding, software, and content are owned by us or our licensors. Shop owners retain rights in their product listings and materials they upload, and grant us a licence to display them so we can operate the connection platform.
8. Disclaimers
The Services are provided on an “as is” and “as available” basis. Because we connect customers with independent shop owners, we do not guarantee uninterrupted availability, error-free operation, that a shop will accept every order, or the quality, safety, legality, or price of any product or delivery arranged by a shop. To the fullest extent permitted by law, we disclaim warranties not expressly stated in these Terms.
9. Limitation of liability
To the fullest extent permitted by law, ShopsAroundU is not liable for claims arising from products, pricing, fulfilment, or delivery handled by shop owners or their delivery partners, or for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the Services. Our total liability for any claim relating to the platform Services themselves is limited to the fees you paid to us (if any) for the Services in the three months before the claim.
10. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Services you also acknowledge that policy.
11. Changes
We may update these Terms from time to time. When we change the version, you may be required to review and accept the updated Terms before continuing to use the Apps. The version and “Last updated” date above will change when we publish revisions.
12. Governing law
These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction, subject to any mandatory consumer-protection venue rules that apply to you.
